Terms & conditions

These T&Cs tell you the contractual terms on which you may make use of our websites: tpt.org.uk, employers.tpt.org.uk, memberonline.tpt.org.uk and members.tpt.org.uk: (the “Websites”) 

Please read the T&Cs carefully before you start using the Websites. By accessing the Websites you will be deemed to have accepted, and be bound by, these T&Cs. If you do not agree to the T&Cs, you must not use any of the Websites for any purpose.

The Websites are operated by the following: 

Verity Trustees Limited (registered company number 00744017) as trustee (the “Trustee”) of The Pensions Trust and The Pensions Trust 2016 (the “Schemes”) 

TPT Retirement Solutions Limited (registered company number 09639961) (“TPTRSL”)

(collectively “we”, “us”, “our” or individually the “Trustee”, “TPTRSL” or “TPTIML”)

Copyright 

We are the owners of all copyright, design, graphical and content elements, database rights and other intellectual property rights unless otherwise stated. 

All images, logos, names and trademarks on the Websites are proprietary marks and belong to us  and any applicable third parties. Unless otherwise agreed in writing with us, nothing on the Websites can be used by any other person or company and any unconsented use may constitute an infringement of our rights. 

 

Disclaimer 

We have taken all reasonable steps to ensure the accuracy and completeness of the content of the Websites and we do our best to correct any errors and omissions as soon as we are aware of them. The information contained on the Websites is based on legislation and tax regulations in force at the time of publication and all benefits are always subject to relevant applicable limits such as the lifetime allowance and annual allowance set by HM Revenue & Customs (“HMRC”).  

No information on the Websites represents a promise or guarantee of the amount of any benefits that you might receive at retirement or in any other circumstances. Benefits are determined by the rules of the Schemes and subject at all times to the prevailing HMRC limits and any other overriding statutory and regulatory provisions. Similarly, no information contained on the Websites represents an indication, promise or guarantee of investment performance. 

If there is any conflict between any information given on the Websites and the trust deed and rules or any other Scheme document (the “Scheme Documents”), the Scheme Documents will prevail subject only to HMRC limits and any other statutory and/or regulatory provision. Copies of the Scheme Documents are available from us. We accept no liability arising out of or in connection with the use of or access to the Websites and access to and use of the Websites is entirely at the users’ own risk. In accessing and using the Websites, you are expressly agreeing to all the T&Cs but we would particularly draw your attention to those set out in this paragraph entitled “Disclaimer” together with those set out in the paragraph entitled “Important notice – financial and legal” immediately below.

Important notice - financial and legal advice

Any information that is provided to members, prospective members or any other person (whether an individual or a company) should be taken as general information only and not advice or recommendation of any kind (whether financial, legal or otherwise). 

When providing general information to members, prospective members or any other person, we take reasonable care to make sure that this is accurate. However, any decision or choice made after accessing the Websites remains solely the individual's and we are not responsible in any way for such decisions and choices. 

We would therefore strongly recommend that anyone accessing the information on the Websites takes independent financial advice in their individual circumstances. Where needed in their particular circumstances, we would also recommend that anyone who is in doubt as to the consequences of any decisions concerning their pension and other investments takes legal advice from a solicitor or seeks assistance from the Citizens’ Advice Bureau.

More about the Trustee

The Trustee is a company (otherwise called a corporate trustee) and it is run by ten trustee directors - ​four elected by members, ​four elected by employers and ​two co-opted by the elected directors.

The day-to-day administration has been carried out by the Trustee which has been administering pension schemes since 1946. The Trustee is directly answerable to its beneficiaries which include the employers who choose to participate in the Trustee’s pension schemes, the active members, pensioners and deferred members (those who have left employment to which the scheme relates) who belong to the Schemes. The Trustee is not an insurance company.

In addition, TPTRSL and TPTIML provide specialised services such as administration and investment management to the Schemes. TPTRSL and TPTIML are wholly-owned subsidiaries of the Trustee.  

 

Availability of the Websites

While we have taken care in the provision of the Websites, we cannot guarantee that you will have uninterrupted or error free access to the Websites at all times. Access may be suspended occasionally or restricted to allow for repair or maintenance or for the introduction of new services. We cannot be liable for any consequences that arise out of or in connection with any such lack of availability of the Websites at any time.

 

Virus protection

We make every effort to check and test the Websites for viruses at every stage of production, running and maintenance. You must make sure that the way you use the Websites does not expose you to the risk of viruses, malicious computer code or other forms of interference which can damage your computer system.

We are not responsible for any loss, disruption or damage to your data or computer system arising out of or in connection with your use of the Websites.

 

Viruses, hacking and other offences

When using the Websites, you must not introduce viruses, trojans, worms, logic bombs or any other material that is (or might be) malicious or technologically harmful.

You must not try to gain unauthorised access to the Websites, the server on which it is stored or any server, computer or database connected to it.

You must not attack the Websites in any way or facilitate (or attempt to facilitate) any other person doing so (or attempting to do so). This prohibition includes denial-of-service attacks.

We will report any attacks or attempts to gain unauthorised access to the Websites to the relevant law enforcement authorities and share information about you with them.

 

Use of personal information

These T&Cs should be read in conjunction with the privacy policy and cookie policy for the Websites which tell you how we collect and use information you provide to us. You acknowledge and accept that the privacy policy and the cookies policy are incorporated into these T&Cs. They are set out in separate documents for ease of reference and clarity.

If you do not agree to be bound by the T&Cs (including the separate terms of the privacy policy and cookie policy) you must not use the Websites. If you do use the Websites, you agree that in doing so you are giving your express consent to the T&Cs as well as the terms of the privacy policy and the cookie policy.

We do not collect any personal information from people using the “public” areas of the Websites. We only collect personal information that you volunteer when you interact with the Websites by completing any of the enquiry or online forms and when you use your online accounts.

The information that we collect via the Websites may include (without limitation):

  • any personal details that you type in and submit to us;
  • data that allows us to remember you and how you use the Websites;
  • your IP address (this is your computer's individual identification number for internet connection) that is automatically logged by our web server;
  • and 4. numbers of visitors to the Websites and about the places in the UK from which visitors access the Websites.

We need to collect and use personal information to provide you with an optimal service. All personal data will be used by us (and where relevant shared with suppliers who act on behalf) for the purposes of providing that service.

We will not pass any information to any company outside our group of companies - or to companies who are not our designated suppliers - without your consent except where we believe that this may  help prevent fraud or if we are required to do so by law.

We may provide links to other websites that are not under our control. These links are provided for your convenience. When you activate these links, you will leave the Websites. We do not endorse or take responsibility for the content on any third-party websites or their availability. We are not liable for any loss or damage that you may suffer by using those websites and you accept that you are accessing linked websites entirely at your own risk.

 

Site access and password usage

The Websites are intended to be used only by UK residents.  

To obtain access to certain online services, you are given the opportunity to register with us via your employer.  

You are responsible for maintaining the confidentiality of your details and your password and for restricting access to your computer to prevent unauthorised access to your account.

You accept responsibility for all activities that occur in respect of your account and you agree to take all steps necessary to ensure your password and any of your personal data is kept confidential.  You agree to inform us immediately if you suspect your password or any of your personal data is being used in an unauthorised manner.
